By accessing and using SimplexPros's services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

SimplexPros provides managed web hosting, website care, migration, and security services. We reserve the right to modify, suspend, or discontinue any service at any time with appropriate notice.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your use of services complies with applicable laws
  • Providing accurate and complete billing information

4. Payment Terms

Services are billed monthly or annually in advance. All fees are non-refundable except as specified in our 30-day money-back guarantee. We reserve the right to suspend services for non-payment.

5. Acceptable Use

You agree not to use our services to:

  • Distribute malware, spam, or malicious content
  • Infringe on intellectual property rights
  • Engage in fraudulent or illegal activities
  • Violate the rights of others
  • Overload or disrupt our infrastructure

6. Uptime SLA

We guarantee 99.9% uptime for all hosting plans and 99.99% for Enterprise plans. In the event of an outage exceeding these thresholds, you may be eligible for service credits as outlined in our SLA documentation.

7. Limitation of Liability

SimplexPros shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

8. Termination

Either party may terminate services with 30 days written notice. We reserve the right to terminate immediately for violations of these terms. Upon termination, your data will be available for download for 30 days.

9. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the new terms. We will provide 30 days notice for material changes.
